Acceptance of Terms

By accessing or using the NXGOAI website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the revised terms.

Services Provided

NXGOAI provides professional technology services including, but not limited to:

• ✓Technology consulting and digital strategy
• ✓Custom software development and engineering
• ✓AI integration and intelligent automation
• ✓Web, mobile, and API development
• ✓Cloud infrastructure and DevOps
• ✓UI/UX design and digital product design

The specific scope, deliverables, and timeline for any engagement are defined in a separate project agreement or proposal.

Payment Terms

Payment terms are agreed upon via contract or written proposal prior to the commencement of any work. Standard terms include a deposit before work begins, with the remaining balance due upon project completion or per milestones as defined.

Late payments may incur interest charges as specified in the project agreement. NXGOAI reserves the right to pause or suspend work on projects with outstanding invoices.

Intellectual Property

Upon receipt of full payment, the client owns all custom deliverables created specifically for their project, including source code and design assets.

NXGOAI retains ownership of all pre-existing intellectual property, frameworks, tools, libraries, and methodologies used in delivering services. Any such components will be licensed to the client for their intended use.

NXGOAI reserves the right to display completed work in its portfolio unless otherwise agreed in writing.

Limitation of Liability

To the maximum extent permitted by law, NXGOAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the total fees paid by you to NXGOAI in the three months preceding the claim.

Termination

Either party may terminate a project engagement with written notice as specified in the project agreement. Upon termination, the client is responsible for payment of all work completed up to the termination date.

NXGOAI reserves the right to terminate services immediately if the client violates these terms or engages in any unlawful activity.

Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable international law. Any disputes arising from these terms or our services shall be resolved through good-faith negotiation before proceeding to arbitration or litigation.
